Onshore and offshore enrollments

The process for enrolling into universities is relatively the same for both international students who are applying from Australia and outside of Australia. However, the Australian government has recently announced certain changes to the Student visa (SC 500) and the Temporary Graduate visa (SC 485) which is the post study work visa. According to these changes offshore enrollments will have a new test for assessing international students called the Genuine student test. According to this test the students have to demonstrate that the course that they are undertaking is related to their previous qualifications and has future value. Further, the department is keen on assessing the genuine accessibility to finances for the duration of study and stay of the students in Australia.

Moreover, onshore student visa applications will be challenging as the government has prohibited visa hopping which essentially bans 485 visa holders to go back on to a student visa. The SC 485 is a popular visa that students use after the completion of their studies in Australia so this prohibition would mean that the students must plan for a PR pathway ahead and have to undertake courses that would lead you to PR. We at MJ Legal are aware of all the changes and are updated with all the policies and legislations. So we will advice you in a manner that you can make decisions that will enable you to have a smooth PR journey.

Courses leading to PR

It is important that your occupation be in the skilled occupation list when you are applying for PR in Australia. The deciding factor to have an occupation in the skilled occupation lists would be your academic qualifications. Your academic qualifications must match your occupation.

The Skilled occupation list has been divided into 3 sub lists:

  • Medium and Long Term Strategic Skills List (MLTSSL)

  • Short Term Occupation Skills List (STOSL)

  • Regional Occupation List (ROL)

So if your occupation which is based on your education is in the MLTSSL you are capable of exploring diverse visas that will lead you to PR. If your occupation which is backed by your education qualifications is on lists other than MLTSSL, then your options might be limited and in certain instances you will not have a PR pathway. We at MJ Legal will help you in navigating these complexities when selecting a course.

CRICOS

CRICOS are standards set by the Australian government. CRICOS are academic programs that offered by educational institutions that are registered on the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS). This is an important component for your long term stay in Australia.

The CRICOS courses are essential for meeting the Australian study requirement. Meeting the Australian study requirement is a mandatory requirements for students who want to apply for 485 visa (Temporary Graduate visa). Having a CRICOS registered course will also help you in getting PR by enhancing your chances in having an occupation in the MLTSSL. The CRICOS courses will also provide you with points for your skilled migration PR pathway.

An important factor to consider would be where some institutions will have CRICOS registrations while some of the courses will not have CRICOS registrations. We at MJ Legal will recognise this important distinction and advise you appropriately.
